VNU LAW attends the International Conference “Sources of Private Law – New Developments in Taiwan and Vietnam”

From June 1 to June 4, 2023, the delegation of the University of Law, Vietnam National University, Hanoi (VNU-UL) led by Assoc.Prof.Dr. Nguyen Thi Que Anh visited the headquarters and coordinated to organize an international conference with two partner universities in Taiwan (China) namely Law School, Chung Cheng University (CCU) and the College of Law, Tunghai University (THU).

These are two prestigious law training institutions in Taiwan, having signed cooperation agreements with VNU-UL (formerly VNU School of Law) since 2017, including the activities of co-organizing the annual conferences in Taiwan and Vietnam to enhance academic exchanges between Taiwanese and Vietnamese scholars to promote the international publication.

On June 1, 2023, the delegation visited Chung Cheng University and joined a meeting to exchange on the preparation of the Conference with Prof. YAO Hsin-An - Vice Rector and Dean of the Faculty of Economic Law and Financial Law; and Prof. JSENG Pin-Chieh - Director of the Center for East Asian Legal Studies.

On June 2, 2023, the international conference within the framework of the 6th Taiwan - Vietnam Legal Forum "Sources of private law - New development in Taiwan and Vietnam" was held. The conference was held at CCU Law School and online using the Google Meet platform. The Conference included the participation of Prof. SHENG Tzu-Lung - Rector of CCU Law School; Prof. LIN Geng-Schenq - Rector of THU Law School; Assoc.Prof.Dr. Nguyen Thi Que Anh – Rector of the VNU-UL and professors, associate professors, lecturers, and postgraduates of CCU Law School, THU Law School, and the VNU University of Law.

Speaking at the opening of the Conference, Assoc.Prof.Dr. Nguyen Thi Que Anh emphasized that the VNU University of Law; CCU Law School, and THU College of Law (Taiwan) have a traditional partnership. After a long gap due to the impact of the Covid-19 pandemic, the three schools are very pleased to restart the Taiwan-Vietnam Legal Forum to promote academic exchange.

She affirmed that in recent years, with the outstanding socio-economic development of Taiwan and Vietnam, private law in these two economies has grown strongly, and various sources of private law have been added to meet the needs of legal regulation of diverse civil relations. "Taiwanese scholars are interested in the development of new sources of Vietnamese private law such as case law and equity, while Vietnamese scholars are into learning from experience in applying sources of private law in Taiwan. Therefore, the organization of the conference is a good opportunity to meet the needs of academic exchanges on both sides" She added.

On behalf of the VNU University of Law, the Rector expressed her sincere thanks to the Governing Board, professors, lecturers, officials, postgraduates, and students of CCU Law School, THU College of Law for the warm welcome, thoughtful, and effective support in the organization of the Conference. The conference was also supported by Coretronic Group (Taiwan) - an enterprise that has investment and business activities in Vietnam.

The conference took place on 2nd June with 4 sessions.

Session 1: General theory 

The session included 4 presentations presided by Prof. YAO Hsin-An. At this session, the speakers presented general theoretical issues about the source of private law and the development history of private law in Vietnam and Taiwan. A.Prof. Dr. Nguyen Thi Que Anh opened session 1 with the presentation "Legal theory in the source system of private law", followed by the presentation "Sources of private law in the law reform process in Vietnam" by A.Pro.Dr. Ngo Huy Cuong led by Dr. Nguyen Bich Thao presented on behalf of the author. Dr. Tran Kien presented the lecture "From the concept of socialist law sources to the concept of Roman law sources: A Journey to the past in Vietnam", and Dr. LEE Chung-Tao, THU College of Law, presented the presentation "Accepting the legal liability for errors of Roman law in modern civil law". Session 1 ended with Prof. LIN Geng-Scheng's comments.

Session 2 "Customs and similar application of laws" 

The session was chaired by Dr. Nguyen Bich Thao including "Customary Law in Vietnamese private law" by Dr. Lawyer. Nguyen Manh Thang, a part-time lecturer at VNU-UL, led by Dr. Tran Kien presented on behalf of the author, and two presentations by postgraduates of CCU Law School. 

Session 3 and Session 4 took place in the afternoon with the respective topics of Case Law and Equity. Session 3 includes 5 presentations focusing on the topics: The role of foreign law and case law in Taiwan's intellectual property law (Prof. YAO Hsin-An, CCU), Expanding the scope of case law in Vietnam: From a legal perspective on liability for damages of legal entities (Dr. Nguyen Thi Phuong Cham and MSc. Dao Trong Khoi, VNU University of Law), Development of contract law in Vietnam: A perspective from published case law (Dr. Truong Huynh Nga, VNU University of Law), Origin and development of insurance law in Taiwan (Dr. LAI Huan-Sheng, Faculty of Risk Management and Insurance, Feng Chia University, Taiwan); The Role of Legal Doctrine in Taiwanese Commercial Law ( YIN Chen-Yuan, CCU postgraduate). Session 3 was presided by Prof. CHIANG Chao-Sheng CCU and Dr. Tran Kien.

Session 4 included 2 presentations: "The Role of Equity in resolving marriage and family disputes in Vietnam" (Dr. Nguyen Bich Thao and Dr. Ngo Thanh Huong, VNU University of Law) and Fair Law applied in the settlement of patent disputes in Court and Arbitration” (Dr. LIN Chin-Lung, National Defense University, Taiwan). The discussion in Session 4 was led by Dr. CHANG Kai-Hsin, THU College of Law.

Speaking at the closing of the Conference, A.Prof.Dr. Nguyen Thi Que Anh and Prof. JSENG Pin-Chieh affirmed that the conference was successfully held with multiple high-quality articles and interesting discussions, helping scholars and students have more understanding of the private law of Taiwan and Vietnam. After the conference, the articles will be appraised and edited for publication in Taiwan and Vietnam. A.Prof. Dr. Nguyen Thi Que Anh cordially invited professors and students of CCU and THU to visit the VNU University of Law and hoped the partners will continue to coordinate in organizing other international conferences in the coming time.

On June 3, 2023, the delegation of VNU-UL visited THU College of Law and attended the workshop "Rule of law and technology" with professors of THU College of Law and representatives of businesses operating in the field of artificial intelligence in Taiwan. At the workshop, Mr. Justin Chang, a representative of IfAIgo Company, presented the application of artificial intelligence in exploiting and analyzing patent information for the assessment of patentability and patent valuation, building competitive strategies, and forecasting litigation risks of technology enterprises. Next, Mr. Daniel Lin, representative of eGroupAI Company presented a presentation on the application of facial recognition technology in many areas of life such as healthcare, human resource management, work progress management, ...

Speaking at the workshop, the Rector of VNU-UL shared about other functions of exploiting patent information such as finding research partners, searching for talents in the field, and selecting suitable technology solutions. etc… She also questioned the ethical aspects of artificial intelligence development and application in Taiwan and the current situation of policy formulation on responsible artificial intelligence.
